Special Council Meeting

April 2, 2007

Present: McClain, Pracht, Hendricks, Riddle (arrived at 7:37 PM)

Absent: Damgaard

Mayor Taylor called the special meeting to order at 7:32 PM.

McClain made a motion to move the agenda item of consideration of a Letter of Endorsement for Riverside Farmers Market to the top of the agenda after the public and to approve the agenda, seconded by Pracht – 3 ayes.

Public was present and no comments were made.

Becky Von Weihe was present to discuss the Riverside Farmers Market. The farmers market will be held on Dr. Thompson Ave in Oakland on Wednesdays from 3:30 – 6:30 PM during the Summer. The market would be only for locally grown produce and local vendors; they hope to hold special events every other week. Hendricks made a motion to approve the City to submit a Letter of Support for the Riverside Farmer's Market, seconded by Pracht 3 ayes.

Riddle arrived at 7:37 PM.

Discussion was held regarding the lawsuit with Eyerly's. Hendricks made a motion to abandon the well located on the Eyerly property, seconded by Pracht – 3 ayes: Hendricks, Pracht, McClain. 1 nay: Riddle. Motion carried. Stillinger will research the costs and procedures of abandoning the well.

Pracht made a motion to table discussion of the City Attorney's Opinion regarding the language in the Gas & Electric Franchise Renewal Ordinances until the May Workshop and to advertise a public notice regarding the attorney's opinion on the franchise renewal, seconded by Hendricks – 3 ayes: McClain, Pracht, Hendricks. 1 abstain: Riddle. Motion Carried.

Stillinger stated that the City needs to hire someone to fill Wayne Turner's position with the Maintenance Department. The position is not full time and does not receive benefits.

Riddle made a motion to advertise to take applications for 1 part time maintenance position with no benefits and one 1 full time maintenance position with benefits, seconded by Hendricks. 2 ayes: Riddle, Hendricks 2 nays: McClain, Pracht. Motion failed.

Pracht made a motion to advertise a part time maintenance position with the potential of becoming a full time position at $10.75/hour. Motion failed for lack of a second.

Hendricks made a motion to advertise a part time position with the potential of becoming a full time position at $9.00/hour, seconded by Riddle – 3 ayes: Hendricks, Riddle, McClain. 1 nay: Pracht. Motion carried.

Hendricks made a motion to approve having the Annual Spring Cleanup Date on Thursday, April 26 th (Rain or Shine) and directed the clerk to advertise the event, seconded by Riddle – 4 ayes. The City Employees will be picking up the appliances that day.

Hendricks made a motion to approve Frontier Communications Request for Use of Right of Way for Utility work in the Tibbles Subdivision, seconded by Pracht – 4 ayes.

Hendricks made a motion to approve Resolution 2007-12 (Approve Application to CITIES Grant Program Spring 2007 for Rodeo Drive Storm Sewer Drainage Improvements), seconded by McClain – 4 ayes.

Hendricks made a motion to table further consideration of Cable installation for the Exercise Room until next weeks meeting, seconded by Pracht – 4 ayes.

Hendricks made a motion to extend the Community Center Grant Anticipation Loan Note until July 2007, seconded by Riddle – 4 ayes.

Riddle made a motion to ask the Fire Department to report when the community center defibulator phone line hookup can be complete, seconded by Pracht – 4 ayes.

McClain made a motion to adjourn at 8:17 PM, seconded by Hendricks – 4 ayes.
